Terms of Service
The terms that govern your use of Languamate.

1. Agreement to terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you and Languamate (“we”, “us”, “our”), governing your access to and use of our website, applications, and services (collectively, the “Service”).
By accessing or using the Service, you agree to be bound by these Terms and our Privacy Policy. By creating an account, you expressly accept these Terms. If you do not agree to these Terms, you must not access or use the Service.
2. Description of the Service
Languamate is a language practice platform that provides tools for creating and accessing interactive vocabulary activities. The Service allows teachers to create activities and share them with students via links or QR codes. Students access and complete activities through a web browser without requiring an app installation.
Certain features of the Service may use artificial intelligence to assist with content generation. AI-generated content is provided on an “as is” basis, and we do not guarantee its accuracy, completeness, or suitability for any particular purpose. Users are responsible for reviewing and verifying any AI-generated content before use. We are not liable for any errors, inaccuracies, or inappropriate content in AI-generated output. You use AI-assisted features at your own risk.
3. Eligibility
You must be at least 13 years old to create an account. If the laws of your country require a higher minimum age or parental consent for account creation, those rules apply. By creating an account, you represent that you meet these requirements.
Student-facing activities (accessed via QR codes or links) do not require an account and may be used by individuals of any age.
4. Account registration and security
Some features of the Service require an account. When you register, you agree to:
- provide accurate, current, and complete registration information;
- maintain and promptly update your account information to keep it accurate;
- maintain the security and confidentiality of your login credentials;
- accept responsibility for all activity that occurs under your account; and
- notify us immediately if you suspect any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms. Where practicable, we will provide notice and an opportunity to remedy the violation before termination, except where immediate action is necessary to protect the Service or its users.
5. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:
- upload, submit, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable;
- include personal data about students or other individuals in activities, word lists, or clues, especially where shared via public links or QR codes, unless you have a lawful basis and any required consents and have taken appropriate steps to restrict access;
- upload or transmit malware, viruses, or any code intended to disrupt, damage, or interfere with the Service or any user's device;
- use the Service to harm, exploit, or endanger minors in any way;
- use the Service to send spam or unsolicited messages;
- impersonate any person or entity, or falsely represent your affiliation with any person or entity;
- attempt to gain unauthorised access to any part of the Service, other users' accounts, or any systems or networks connected to the Service;
- use any automated means (including bots, scrapers, or crawlers) to access the Service, unless expressly permitted by us in writing;
- interfere with or disrupt the integrity, security, or performance of the Service;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service;
- use the Service for any commercial purpose not expressly permitted by these Terms; or
- violate any applicable local, national, or international law or regulation.
6. User content
You retain all ownership rights in the content you create and submit through the Service (“User Content”), including but not limited to word lists, clues, definitions, and activity configurations.
By submitting User Content, you grant Languamate a worldwide, non-exclusive, royalty-free licence to use, store, process, reproduce, and display your User Content solely for the purpose of operating and providing the Service. This includes making your User Content available to people you share links or QR codes with, and sharing your User Content with our service providers only as needed to operate the Service (for example, hosting and content delivery). This licence continues for as long as your User Content remains on the Service. We do not guarantee that User Content will be stored or available indefinitely.
You may delete your User Content at any time. After you delete your User Content, this licence terminates except to the extent copies remain in backups (for up to 30 days, consistent with our Privacy Policy). If you delete User Content, any links or QR codes that point to that content may stop working.
You represent and warrant that you have the right to submit all User Content and that your User Content does not infringe the intellectual property rights or other rights of any third party.
Activities shared via QR codes or links are accessible to anyone who has the link. You are responsible for ensuring that your User Content does not contain sensitive, confidential, or personally identifiable information that you do not wish to make publicly accessible.
7. Intellectual property
The Service, including its design, code, visual elements, branding, logos, and all associated intellectual property, is owned by Languamate and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right, title, or interest in the Service except for the limited right to use it in accordance with these Terms.
You may not copy, modify, distribute, sell, lease, or create derivative works based on the Service or any part thereof without our prior written consent.
If you provide us with feedback, suggestions, or ideas about the Service, you grant us the right to use them without restriction or compensation. We are not obligated to implement any feedback.
8. Copyright complaints
If you believe that any content on the Service infringes your copyright or other intellectual property rights, please contact us at privacy@languamate.com with the following information:
- a description of the copyrighted work you believe has been infringed;
- the location of the allegedly infringing content on the Service (e.g. a link or activity code);
- your contact information;
- a statement that you have a good-faith belief that the use is not authorised by the rights holder;
- a statement that you are the copyright owner or are authorised to act on the owner's behalf; and
- a statement that the information in your complaint is accurate.
Upon receiving a valid complaint, we will investigate and, where appropriate, remove or disable access to the content in question. We reserve the right to terminate the accounts of users who repeatedly infringe the intellectual property rights of others.
9. Fees and payment
The Service is currently offered free of charge. We reserve the right to introduce paid features or subscription plans in the future. If we do, we will provide you with clear notice of any applicable fees before they take effect. Features that are free at the time of introduction will remain free unless we provide reasonable advance notice of a change. If we introduce paid features, any applicable refund terms will be communicated at the time of purchase. Where required by law (including the EU Consumer Rights Directive), you will have the right to withdraw from a purchase within the applicable statutory period, subject to any exceptions for digital content that has been fully provided with your prior express consent.
10. Third-party services and links
The Service may integrate with or contain links to third-party websites, services, or applications (including authentication providers, hosting services, AI providers, and analytics tools). These third-party services are governed by their own terms and privacy policies. We are not responsible for the content, practices, or availability of any third-party services or websites.
Your use of any third-party service is at your own risk. We encourage you to review the terms and privacy policies of any third-party services you access through or in connection with the Service.
11. Classroom use and teacher responsibilities
Teachers who create and share activities are responsible for how those activities are distributed. Activities shared via QR codes or links are accessible to anyone with the link. Teachers should:
- not include personal data about students or other individuals in activities shared via public links or QR codes;
- consider whether links should be shared publicly or only within a controlled setting (e.g. a classroom); and
- ensure that their use of the Service complies with any applicable school or institutional policies.
Teachers should ensure that students are supervised where appropriate. If a teacher is using the Service on behalf of a school or educational institution, the policies of that institution apply in addition to these Terms.
Teachers who enable student progress tracking using student codes may be acting as data controllers under applicable data protection law. Teachers are responsible for ensuring that their use of such features complies with applicable data protection requirements, including obtaining any necessary consents or authorisations. 12. Availability and modifications
We strive to maintain the availability of the Service but do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue any part of the Service at any time. Some features may be offered as beta or experimental and may change or be removed.
Where reasonable and practical, we will try to provide advance notice of material changes or discontinuation. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service. If we discontinue a material part of the Service, we will make reasonable efforts to give you the opportunity to export your User Content before it is deleted.
13. Disclaimer of warranties
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by applicable law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy.
Without limiting the foregoing, we make no representations or warranties that:
- the Service will meet your specific requirements;
- the Service will be uninterrupted, timely, secure, or error-free;
- any content generated by AI or other automated features will be accurate, complete, or reliable; or
- any errors in the Service will be corrected.
14. Limitation of liability
To the fullest extent permitted by applicable law (including Swedish law), Languamate, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- your access to or use of (or inability to access or use) the Service;
- any conduct or content of any third party on the Service;
- any User Content or AI-generated content obtained from the Service; or
- unauthorised access, use, or alteration of your data or transmissions.
To the fullest extent permitted by law, our total liability for any claim relating to the Service shall not exceed (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) €50, whichever is greater. This limitation does not apply where separate written agreements between Languamate and an institution specify different terms.
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law. Nothing in these Terms affects your statutory rights as a consumer.
15. Indemnification
You agree to indemnify, defend, and hold harmless Languamate and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms. This indemnification obligation applies to the fullest extent permitted by applicable law. If you are a consumer in the EU/EEA, this section applies only to the extent permitted by the mandatory consumer protection laws of your country of residence.
16. Termination
You may stop using the Service at any time. You may delete your account via your account settings or by contacting us at privacy@languamate.com.
We may suspend or terminate your access to the Service at any time for any reason. Where practicable, we will provide advance notice. Upon termination, your right to use the Service will cease immediately, though provisions of these Terms that by their nature should survive termination (including but not limited to Sections 6, 7, 8, 13, 14, 15, 18, and 19) shall continue to apply.
17. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge the practices described in the Privacy Policy.
We may send you administrative or service-related messages (for example, security notices or important updates to the Service). These communications are part of operating the Service and are not marketing. You may opt out of marketing communications where offered. Notices under these Terms may be provided by email to your account email address or by posting within the Service.
18. Governing law and dispute resolution
These Terms are governed by the laws of Sweden. If you are a consumer resident in the EU/EEA, nothing in these Terms limits any mandatory consumer protections or rights you may have under the laws of your country of residence.
Before initiating any formal proceedings relating to these Terms or the Service, both parties agree to attempt to resolve the dispute informally by contacting the other party for at least 30 days. You may reach us at privacy@languamate.com.
19. General provisions
- Entire agreement: these Terms, together with the Privacy Policy, constitute the entire agreement between you and Languamate regarding the Service and supersede all prior agreements.
- Severability: if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver: our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
- Assignment: we may assign or transfer our rights and obligations under these Terms without your consent, provided that such assignment does not reduce your rights or protections under these Terms. You may not assign or transfer your rights without our prior written consent.
- Force majeure: we shall not be liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control.
20. Changes to these Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email (if you have an account) or by posting a prominent notice on the Service at least 30 days before the changes take effect. If you do not agree to the revised Terms, you must stop using the Service before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
